REGULATIONS OF THE LOYALTY PROGRAM "LOYAL CUSTOMER CLUB"

§1. General provisions

1. These Regulations define the terms and conditions of the Loyalty Club loyalty program, hereinafter referred to as the "Programme".
2. The Programme is organised by ORSKA sp. k. with its registered office at ul. Folwarczna 91, 62-081 Przeźmierowo, Poland, hereinafter referred to as the "Organiser".
3. The Program is intended for customers – hereinafter referred to as "Participants" – who make purchases in ORSKA boutiques indicated in the Regulations and in the online store, available at www.orskastore.com.
4. The aim of the Program is to reward Participants purchasing products in the form of points, which are collected on the Loyal Customer Account and are subject to registration in the Organizer's database - hereinafter referred to as the "Loyal Customer Club". After collecting the number of points specified in these Regulations, they are subject to exchange for a discount, which is calculated on subsequent purchases in ORSKA boutiques indicated in the Regulations and in the online store available at www.orskastore.com.
5. The Regulations are binding on the Organizer and the Participant from the moment of their announcement.
6. Any rights arising from the Program may not be transferred by the Participant to a third party.

§2. Conditions of participation in the "Regular Customer Club" Program

1. To join the Program, the following conditions must be met:
1. Becoming 18 years of age.
2. Making a purchase in ORSKA boutiques indicated in the Regulations or in the online store available at www.orskastore.com
3. The Participant provides his/her personal data – name, surname, e-mail address, telephone number, city of residence and submits a declaration of the Participant's consent to the processing of his/her personal data for purposes related to the implementation of the Program. Fulfillment of this condition is made by correctly completing and signing this form.
4. Reading and accepting the content of these Regulations.
2. From the moment of joining the Loyalty Club, the Participant may collect points on his/her account obtained during purchases in ORSKA boutiques indicated in the Regulations and in the online store, available at www.orskastore.com.
3. One point awarded to the Account corresponds to one zloty spent.
4. Special, selective offers, invitations or commercial information may be sent to Program Participants.
5. A Regular Customer Account is assigned to only one Program Participant.
6. The Participant is not allowed to make the Account available to third parties, under penalty of deprivation of the privileges resulting from the Program, including the loss of points collected on the Account.
7. The Loyalty Club is valid in the following ORSKA boutiques: Poznań Stary Browar, Warsaw Dom Handlowy Mysia 3, Warsaw Elektrownia Powiśle, Bydgoszcz Zielone Arkady and in the online store, available at www.orskastore.com.
8. The Organizer or its employee may ask any person belonging to the Loyalty Club to present an identity document in order to confirm the authorization of a given person to use the Loyalty Account.

   §3. Accumulation of points on the Program Participant's account

1. Points in the Program are awarded for making purchases in ORSKA boutiques indicated in the Regulations or in the online store, available at www.orskastore.com.
2. Points can only be accrued after each confirmation and correct verification of the e-mail address or telephone number of the Program Participant.
3. Points may also be awarded for making purchases in the online store run by the Organizer at www.orskastore.com. For this purpose, the Program Participant must create a user account in the Organizer's online store using the e-mail address and personal data provided to the Organizer. The Participant must provide information about creating a user account in the Organizer's online store to the e-mail address: contact@orskastore.com. After receiving e-mail confirmation of connecting user accounts in the online store, the Program Participant will automatically be awarded points for each purchase in the online store.
4. After collecting 2,000 points worth 2,000 euros and/or dollars on the account, the Program Participant receives a 10% discount on each subsequent purchase in selected ORSKA boutiques and in the online store, available at www.orskastore.com, provided that the Participant correctly verifies their participation in the Program when making the purchase in the brick-and-mortar boutique, and in the case of a purchase in the online store, the Participant makes the purchase from an active account.
5. The discount assigned to the Program cannot be combined with other discounts and offers.
6. If the Participant returns the purchased products, the points that were awarded for their purchase will be deducted from the Account by the Organizer. The points will be deducted in the same number in which they were added in connection with the purchase of the product that was subsequently returned by the Participant.
7. The Participant is entitled to receive information about the Program account balance and the number of points collected on the Account at any time. Such information can be obtained in person when making purchases in the boutique or by e-mail, by sending a request to the Organizer at the e-mail address: contact@orskastore.com
8. The Organizer reserves the right to refuse the Participant the possibility to make a purchase using the Account (and to accrue points) in the case of purchasing goods in wholesale quantities or goods purchased in such circumstances that indicate that the purchase is made by the Participant in connection with his/her commercial or business activity, and in particular for the purpose of resale.
9. Points collected on the Participant’s Account cannot be exchanged for cash, nor can they be transferred or sold by the Participant to third parties.

   § 4. Processing of personal data

1. At the time of joining the Program, the Participant provides personal data (indicated above) necessary for participation in the Program. Providing this data is voluntary, and failure to provide it prevents the creation of participation in the Program. Withdrawal by the Participant of consent to the processing of personal data for the purposes of the Program is equivalent to termination of participation in the Program. In such a case, the issued Card will be blocked, and the second sentence of § 5 section 3 of the Regulations applies.
2. Furthermore, the Participant voluntarily consents to the multiple processing by ORSKA sp. k. with its registered office in Przeźmierowo of his/her personal data indicated above (without transferring them to third parties), in accordance with art. 6 sec. 1 letters a), b) and f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016 (OJ EU.L. No. 119, p. 1).
3. Personal data provided by Participants in accordance with paragraphs 1 and 2 above will be processed for the purpose of fulfilling the obligations of the Organizer towards Participants stipulated in these Program Regulations and for purposes resulting from legally justified interests pursued by ORSKA sp. k., as well as for the purpose of executing the agreement concluded with the Participant and for marketing and commercial purposes (sending commercial information electronically, in the form of SMS and MMS messages).
4. The Participant has the right to access the content of their data and to correct, change and delete it. In order to exercise these rights, the Participant may send an appropriate request to the Organizer at the e-mail address: contact@orskastore.com.
5. Personal data will be stored for the duration of participation in the Program, as well as after the end of such participation, for a period consistent with the provisions of law. In the case of processing personal data for legally justified purposes of Orska sp. k., the data is stored for the duration of these purposes and based on the Participant's consent - until the consent is withdrawn.

   § 5. Final provisions

1. Information regarding the Program is available on the website www.orskastore.com.
2. The Organizer is entitled to close the Participant's Account at any time due to the Participant's violation of the Terms and Conditions, in particular through improper use of the Account, providing false data or impersonating another person. The points collected on the Account of such Participant are canceled in their entirety.
3. The Participant may resign from the Program at any time. The resignation is submitted in writing at one of the boutiques indicated in the Regulations or by e-mail sent to the address: contact@orskastore.com. Upon delivery of the resignation, all points collected on the Account are canceled and the Participant's Account is closed.
4. The Organizer reserves the right to change these Regulations at any time, without giving reasons, with the proviso that for a period of 1 month from the publication of information about the change, in accordance with paragraph 5 below, the Participant has the right to collect points and exchange them for benefits provided for in the Regulations, on the existing terms.
5. Information about changes to the Regulations will be published on the Organizer's website at: www.orskastore.com.
6. The program is valid for an indefinite period. The Organizer reserves the right to terminate it at any time, without giving a reason. The Organizer will inform about the termination of the program on the website www.orskastore.com 1 month in advance.
7. ORSKA sp. k. with its registered office in Przeźmierowo informs that it is the Organizer of the Program as a result of taking over the place of the previous Organizer (ORSKA. Anna Orska with its registered office in Poznań) and taking over all obligations and rights related to running the Program, and ensures that all issued Loyalty Cards and created Participant accounts related to them will be honored and serviced on the same terms as before. Participant accounts remain active and the points accrued remain valid.
8. ORSKA sp. k. with its registered office in Przeźmierowo informs that as a result of the takeover of the Program referred to above, ORSKA. Anna Orska has ceased to act as the administrator of the personal data of the Program Participants. In connection with the above, starting from 01.01.2024, ORSKA sp. k. with its registered office in Przeźmierowo will act as the Administrator of the Personal Data of the Program Participants. The contact details of the new Administrator are indicated in § 1 point 2 of these Regulations. The scope of personal data and the purpose of their processing by ORSKA sp. k. have not changed. ORSKA sp. k. continues to ensure the security of the personal data of the Participants, which are still processed in accordance with the GDPR. More information on the principles of personal data processing is included in the Privacy Policy posted on the website www.orskastore.com.

The above Regulations are effective from 01/09/2024.
